Terms of Service

1. Acceptance of Terms
By downloading, installing, purchasing, or using Chhaya ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the Software. These Terms constitute a legally binding agreement between you and Chhaya.
2. License Grant & Restrictions
Upon purchase and successful activation, Chhaya grants you a personal, non-exclusive, non-transferable, single-device lifetime license to use the Software.
- The license is granted to the individual purchaser only. It may not be shared, gifted, sold, or transferred to any other person or entity.
- The license is valid for activation on one (1) device at a time. You may deactivate the Software on your current device and activate it on a new device, subject to the activation process.
- Redistribution, resale, sublicensing, renting, or commercial distribution of the Software or your license key is strictly prohibited.
- Reverse engineering, decompiling, disassembling, or creating derivative works from the Software is not permitted.
- You may not circumvent, disable, or tamper with the licensing or activation mechanisms of the Software.
Your purchase grants a lifetime license for the current version of Chhaya — you will never be charged a subscription fee for the version you purchase.
3. User Responsibility & Verification
Chhaya is a tool that assists you in protecting sensitive information in documents. The Software does not guarantee the complete or perfect identification and protection of all sensitive content in every document under all conditions.
- You are solely responsible for verifying that all sensitive information has been successfully protected before sharing any document.
- You must conduct a final visual check of every document after applying protection and before sharing it.
- You are solely responsible for the documents you process, protect, and share using the Software.
- Chhaya is not responsible for any consequences arising from documents you share, including documents where sensitive information was not successfully protected.
- Use the Software with appropriate professional judgment at all times.
OCR (Optical Character Recognition) technology used for scanned documents may not detect all text in all circumstances, particularly in very low quality scans, unusual fonts, or heavily degraded documents. Always verify manually before sharing.
4. Acceptable Use
You agree to use Chhaya only for lawful purposes and in compliance with all applicable laws and regulations in your jurisdiction.
- Chhaya is intended to be used to protect your own documents or documents for which you have appropriate authorisation.
- You must not use Chhaya to alter, destroy, or conceal information in documents in a manner that constitutes fraud, obstruction of justice, or any other illegal act.
- You must not use Chhaya to tamper with evidence, legal documents, or regulatory filings in violation of applicable law.
5. Software Provided "As-Is"
Chhaya is provided "as-is" and "as-available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
We do not warrant that:
- The Software will be error-free, uninterrupted, or free from bugs or defects.
- The Software will identify and protect all sensitive content in every document under all conditions.
- The Software will meet every specific use case or professional standard required in your jurisdiction.
- Results produced by the Software will be legally sufficient for compliance with any specific regulation or law.
6. Refund Policy
Because Chhaya is a digital software product that provides immediate, lifetime offline access upon activation, the following refund policy applies:
- After activation: Refunds are not available. Once the Software is activated, the full lifetime license value has been delivered to your device.
- Technical issues: If the Software fails to function due to a verifiable technical defect that we are unable to resolve after reasonable support efforts, we will consider a refund on a case-by-case basis.
- Refunds are not available for reasons including but not limited to: change of mind, purchase by mistake after activation, or dissatisfaction with OCR accuracy on specific document types.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Chhaya and its creators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the Software, including but not limited to:
- Loss of data or documents
- Unauthorised access to information in documents processed with or without the Software
- Failure of the Software to detect or protect specific sensitive information
- Decisions made based on documents processed using the Software
- Any regulatory penalty, fine, or legal liability arising from documents you share
- Any damage to your device, hardware, operating system, or other software arising from or in connection with the installation or use of Chhaya, or from using Chhaya in combination with any other application
- Any third-party claims arising from your use of Chhaya
Our total aggregate liability to you for any claims arising out of or related to these Terms or the Software shall not exceed the amount you paid for the Software.
8. License Key Security
Your license key is unique to your purchase. You are responsible for keeping your license key secure.
- Do not share your license key with any other person.
- If you suspect your license key has been compromised or used without your authorisation, contact us immediately at support@getchhaya.com.
- Chhaya reserves the right to revoke a license key if it is found to be shared, resold, or used in violation of these Terms, without refund.
9. Updates & Future Versions
Your lifetime license covers the current version of Chhaya at the time of purchase and minor updates within that version. We may offer major version upgrades separately. We will make reasonable efforts to notify users of significant updates via the email address provided during purchase.
10. Mobile & Future Platform Availability
Chhaya is currently available as a Windows desktop application. We intend to develop versions for Android and iOS platforms in the future. Customers who purchase a lifetime license may receive access to mobile versions at no additional charge, subject to our discretion at the time of release.
The development and release of mobile or any other platform versions of Chhaya is not guaranteed. Technical, regulatory, commercial, or other constraints may prevent or delay mobile development. Your purchase constitutes a license for the Windows desktop version of Chhaya only. The availability of future platform versions is a statement of intent, not a contractual commitment.
- Chhaya shall not be liable for any claim, loss, or demand arising from the non-availability, delay, or discontinuation of any planned platform version.
- You may not seek a refund solely on the basis that a mobile or other platform version was not released.
11. Termination
We reserve the right to terminate or suspend your license immediately, without notice or refund, if you breach any provision of these Terms. Upon termination, you must cease all use of the Software and delete all copies in your possession.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India. If you are accessing Chhaya from outside India, you are responsible for compliance with local laws.
13. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Software, you agree to first attempt to resolve the matter informally by contacting us at support@getchhaya.com. We will make reasonable efforts to resolve disputes within 30 days. If informal resolution fails, disputes shall be submitted to binding arbitration under applicable Indian law before formal legal proceedings are initiated.
14. Changes to These Terms
We reserve the right to update these Terms of Service at any time. The updated date at the top of this page reflects the most recent revision. Continued use of the Software after changes are posted constitutes your acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify users via email.
